General Terms and Conditions
Any order placed implies unreserved acceptance of our general sales conditions by the customer. These conditions are contained in the catalog and online store in force on the date of the respective order, the contents of which, by the same, you declare to be aware of in advance. No clause that contradicts the aforementioned conditions may be opposed to Cobermaster, unless Cobermaster has formally accepted it in writing. These general sales conditions are only applicable to entities based in Portuguese territory. Purchase and sale contracts will be considered concluded on the date on which the buyer receives confirmation of the order from Cobermaster.
The products available for sale are those contained in Cobermaster’s digital catalog, printed catalog and online store, with Cobermaster reserving in advance the right to change, at any time, the range of its products, which are limited to existing stock. The technical specifications of the products are those mentioned in the catalogue, except for printing errors in the photo or text. All products in Cobermaster’s printed and digital catalog and online store are subject to changes and improvements, and may even be discontinued if Cobermaster so decides.
Cobermaster cannot be held responsible if there are errors in the values and/or characteristics of products when these arise from technical problems beyond its control.
Cobermaster undertakes to deliver the goods to the address indicated by the customer, as long as its facilities are located at ground level and in mainland Portugal. If the location indicated by the customer does not comply with these conditions, Cobermaster may, at the customer’s request, and as an ancillary service, deliver the order to the indicated location, with the costs of this service being borne by the customer. In case of omission on the part of the customer, that the unloading location does not meet the conditions indicated above or the offer of the additional delivery service is not accepted, the risk of the merchandise is attributed to the customer, provided that it is transported to the address indicated by him. Cobermaster does not assemble or install the products supplied, unless expressly requested by the customer to do so. Cobermaster has an assembly and installation team that can provide this service to the customer by presenting a quote that must be accepted by the customer at the time of award.
Upon receipt of the merchandise, the customer, in the presence of the carrier, must check the good condition of the delivered merchandise and the number of packages received with the information stated on the delivery note. If the packaging shows signs of damage or tampering, the customer, in the presence of the carrier, must open it, checking the condition of the merchandise and recording these facts on the delivery note. If possible, we advise you to take photographs that can help prove the condition of the packaging. Such situations must be communicated to Cobermaster in writing within a maximum period of 72 hours, otherwise any complaints in this regard will not be accepted. The procedure referred to above also applies to possible non-compliances relating to the provision of services ancillary to the sale that may eventually be agreed.
When confirming the purchase order, the customer will be informed of the deadline established for the requested products, with the shipping of products in stock, made within 5 (five) working days from the confirmation of the order, or if applicable, the respective payment, except in the case of stock-out, modification of technical specifications, cases of force majeure or any other exceptional circumstances. Whenever Cobermaster is unable to send the ordered products, due to the facts mentioned above, Cobermaster undertakes to inform the person placing the order of this failure, and may have alternative products with the same characteristics. Cobermaster does not guarantee the effective delivery time of ordered products due to delays that may occur between shipping and receipt, which do not give the customer the right to cancel the order or claim any compensation, for whatever reason, if the Cobermaster in these situations, inform the customer about the reasons for the delay. The deadlines communicated by Cobermaster are merely indicative, meaning that in any case of non-compliance, Cobermaster cannot be held responsible. After verifying a period of more than 30 business days between order confirmation and the defined or effective delivery deadline, the customer may cancel, in whole or in part, the order as long as it is in writing and Cobermaster confirms receipt of such communication. The order of products supplied to order that involves manufacturing or transport cannot be cancelled, unless Cobermaster confirms that the manufacturing of this order has not yet started.
Cobermaster is allowed to make partial deliveries of orders, particularly when there are no products in stock.
The prices in the Cobermaster catalogs are per unit, set in euros, excluding VAT, with transport to the continent and packaging included. The packaging has no recovery value. Products not listed in this catalogue/website will be quoted in writing, on a case-by-case basis. Purchase prices are the prices in force at the time of the order, to be confirmed when accepting the respective order for the product, deducting, if applicable, any of the relevant bonuses or campaigns and plus the respective VAT value at the rate in force at the time. , except printing text or photo error. If for economic reasons, particularly in the case of an increase in the price of raw materials, some prices may be changed before the end of the catalogue’s validity period, the customer will be informed of this change at the time of ordering and respective confirmation.
Payment for orders placed with Cobermaster with a value equal to or less than €100.00 (one hundred euros), excluding VAT, must be made within five (5) working days after order confirmation, via bank transfer to Cobermaster account with IBAN PT50 0010 0000 3568 0550 0011 1. In other cases, payment of invoices must be made within 30 (thirty) days after the last day of the month in which they are issued, unless the granting of credit is not accepted. Other payment terms can be negotiated but these must be agreed and accepted in writing by Cobermaster and the customer. Payment may also be made by bank check, sent to the Cobermaster headquarters listed in these catalogues, or by bank transfer to the bank account mentioned above.
Failure to meet the payment deadline for an invoice will result in the immediate forfeiture of all remaining invoices and the suspension of any granting of credit. Cobermaster is also authorized, in these circumstances, to cancel other orders already placed. The customer must also, in the event of default, bear all expenses and costs of debt collection. Customers in debt relating to the payment of any invoice will incur interest until the day of payment, calculated at the legal rate in force for commercial operations. In the event of partial payments of amounts in arrears, these amounts paid will first be charged to the collection expense, then to late payment interest and finally to the capital debt. In any case, the customer may refuse Cobermaster to pay for the goods and services provided, or make any reduction or compensation without Cobermaster’s prior written authorization.
After delivery of the ordered products, the customer has a period of 30 (thirty) days to complain about any non-compliance with them and/or request their return, in writing to Cobermaster. We will only accept returns or exchanges of products, as long as the products to be returned are in the exact condition in which they were received, that is, in perfect condition, with all their accessories and respective documentation and in their original, unmodified packaging. Failure to comply with the previous conditions implies refusal to accept the return. In the case of custom-made products that involve manufacturing or processing, returns or exchanges are not accepted, unless non-conformity between the product supplied and the product ordered is proven. Transport of the merchandise to be returned or exchanged will be requested by Cobermaster. The cost of transportation is borne by Cobermaster if the exchange or return is due to proven non-conformity of the product ordered and received. In other cases, the shipping cost will have to be charged to the customer.
The products included in the Cobermaster catalog benefit from a 24 (twenty-four) month warranty against damage from the date of issue of the respective invoice.
The warranty covers the repair of the product (including spare parts and technical assistance) and Cobermaster, if it so wishes, may replace the product with another of the same or equivalent functionality.
After more than thirty (30) days from the date of delivery of the product, the cost of packaging and shipping the defective product, between the customer and Cobermaster and vice versa, is the responsibility of the customer.
For the warranty to be valid, the customer must communicate the defect to Cobermaster by registered letter with acknowledgment of receipt. The product must then be returned, accompanied by a copy of the respective invoice. Finally, an analysis will be carried out at Cobermaster’s facilities in order to find the reported defect and its cause.
The warranty will be excluded in the following cases:
a) Abnormal, inappropriate or non-conforming use of the product according to its technical characteristics, customer negligence in the installation, maintenance or storage of the product;
b) Normal wear and tear, particularly with regard to consumables;
c) Processing or incorporation of the product or incompatibility with other materials.
